In what can be termed as a big development in the state’s legal and administrative structure, the Maharashtra government has named senior counsel Milind Sathe as the new AG of the state. The appointment was cleared in the cabinet meeting held in Nagpur, following the resignation of earlier Advocate General Birendra Saraf in the beginning of the year. Sathe will begin taking charge from tomorrow onwards as the top legal advisor and chief representative of the state in courts.
Milind Sathe is a highly respected figure in the legal world. He enrolled as an Advocate with the Bar in 1982 and has been practicing for more than four decades. His areas of legal expertise include Constitutional law, Administrative law, Public Interest Litigation, and cases involving State authorities and public-sector undertakings. In 2005, he was designated as a Senior Advocate by the Bombay High Court, a privilege conferred on lawyers of the highest standing and repute.
Sathe has, over the years, appeared in several major matters before the Bombay High Court and the Supreme Court of India. An illustration of his illustrious career can be gleaned from the fact that he has been appointed as an amicus curiae in various cases to assist the court on intricate questions of law. He has represented major city institutions such as MCGM, various state departments, public-sector units, and regulatory bodies. This experience is expected to prove valuable as he takes on the responsibility of overseeing the state’s legal strategy.
Sathe was also President of the Bombay Bar Association-an influential body of lawyers in Mumbai-from 2014 to 2021. During his tenure, BBA initiated several programs aimed at institutionalizing dialogue between the Bar and the Bench, promotion of legal education, and welfare measures for lawyers. He has been called meticulous, persuasive, and deeply committed to the independence of the judiciary by his colleagues.
The role of an Advocate General is constitutionally important. As the chief legal advisor to the Government of Maharashtra, the AG represents the state before the Bombay High Court and the Supreme Court in all major litigations. It is also instrumental in advising the government on constitutional issues, preparing responses in high-profile cases, and advising on policymaking from a legal perspective. Given Maharashtra’s ongoing cases on governance issues, infrastructure, public health, and several regulatory disputes, Sathe’s appointment is both timely and strategic.
The legal fraternity has welcomed the appointment. Senior lawyers say that with Sathe’s long experience in arguing cases on behalf of state bodies, the transition is seamless, more so at a time when the state is facing several complicated issues. Familiarity with the procedures of the government, coupled with a reputation for balanced legal interpretation, is what promises stability for the AG’s office.
Sathe replaces Birendra Saraf, who resigned in September for personal reasons but continued in charge till a successor was named. Saraf’s term saw several high-profile cases involving civic administration, political disputes, and regulatory challenges. Sathe will now inherit many of these matters and provide continuity to the state’s legal responses.
Among the critical cases that will confront him are those related to urban development, environmental clearances, infrastructure planning, and disputes between several state agencies. The state government will be highly dependent on Sathe’s advice during the next year as it tackles issues relating to public interest and some politically sensitive issues. Political analysts said the appointment also signals the state’s intention to strengthen its position in legal battles that might arise ahead of the 2025 civic and municipal decisions. Various departments are engaged in major infrastructure works involving housing, transport, and water management, increasing legal scrutiny of government actions. Sathe’s expertise in administrative and public-law matters is likely to help the government defend its decisions effectively. As he assumes his charge, Milind Sathe carries the confidence of both the legal fraternity and the state government. The appointment is not a mere change of guard, but an opportunity to reinforce the state’s legal strategy with clarity and consistency by bringing in vast experience. Maharashtra now looks towards its newly appointed Advocate General to lead the administration through future legal hurdles efficiently and equitably.
