The woman approached the High Court on the grounds that, according to the Right to Education Act, 2009, and Rights of Persons with Disabilities Act, 2016, she applied for admission for her twins under the provisions relating to children with disabilities. Although she complied with all the criteria for eligibility and also provided the necessary medical and legal documents certifying autism, a recognized disability, the school denied the children admission without valid or lawful reason.<\/p>\n\n\n\n
The mother has contended that denial of admission amounts to discrimination and is violative of the fundamental right to education under Article 21A of the Constitution. She has also argued that autism as a disability has been specifically defined in Indian law and that schools are legally bound to accommodate rather than summarily reject applications of students with disabilities. Activists for the rights of people with disability have welcomed the move by the mother, terming it a “courageous step” that is reflective of the daily struggle families with special-needs children face. They note that access to mainstream education at the formative years is crucial in aiding social development and confidence of children on the autism spectrum. Experts also stress that early inclusion and supportive learning environments significantly improve long-term outcomes.<\/p>\n\n\n\n
The state education department, while making its prima facie response, showed that it would look into whether due process was maintained by the school and if the concerned law was followed. The officials admitted that even when policy guidelines were clear on inclusive education, implementation remained a challenge, and assured the court of all cooperation in the case.<\/p>\n\n\n\n
With the case now awaiting hearing, the Honourable High Court would carefully see whether the action on the part of the school runs afoul of the existing legal protection for children with disabilities. The result could be pretty far-reaching and might affect how admission is conducted in schools of Maharashtra and probably elsewhere.
